1. Acceptance of Terms

By using our services, you agree to these terms. If you do not agree, do not use our services.

2. Services

CatchBack provides a platform for trading collectibles, including:
  • Marketplace for buying and selling cards
  • Pack opening services
  • Vaulting and storage services
  • Auction services
  • Card-backed loans

3. User Accounts

You are responsible for:
  • Maintaining the security of your account
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized access
You must be at least 18 years old to use our services. Text Confirmation and Communications Opt-In (iOS App). When you provide text (SMS) confirmation in order to use the CatchBack iOS app, you affirmatively consent to and opt in to receiving communications from CatchBack about your account, your orders, and the broader CatchBack ecosystem. These communications may be delivered by text message and other channels and may include account notifications and alerts, order confirmations, shipment and delivery updates, and news, offers, and updates about CatchBack products, services, and features. Message and data rates may apply. You may opt out of these communications at any time by following the unsubscribe instructions provided in the messages or by contacting us at catchbackcards@gmail.com. 4. Acceptable Use

You agree not to:
  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or illegal activities
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Interfere with the operation of our services
  • Use automated systems to access our services without permission

5. Transactions

  • All transactions are final once completed
  • We reserve the right to refuse or cancel any transaction
  • Prices are subject to change without notice
  • We are not responsible for disputes between buyers and sellers

6. Fraudulent Activity and Payment Withholding

CatchBack is committed to maintaining a secure and trustworthy platform. In the event of any suspected fraudulent activity, unauthorized transactions, payment disputes, or violations of these Terms of Service:
  • Payment Withholding: CatchBack reserves the right to withhold, freeze, or delay any payouts, refunds, or disbursements associated with your account or transactions.
  • No Payout Obligation: Payouts will not be sent back to users in cases where fraudulent activity is suspected or confirmed. Any funds associated with fraudulent transactions may be retained by CatchBack.
  • Chargeback and Dispute Resolution: CatchBack reserves the right, at its sole discretion, to resolve any chargebacks, payment disputes, or related matters in the manner it deems appropriate. This includes, but is not limited to, determining the validity of claims, reversing transactions, and allocating funds.
  • Account Suspension: Accounts suspected of fraudulent activity may be immediately suspended or terminated pending investigation.
  • Cooperation with Authorities: CatchBack reserves the right to cooperate with law enforcement and regulatory authorities in investigating suspected fraudulent activity and may disclose relevant information as required by law.
  • No Liability: CatchBack shall not be liable for any losses, damages, or inconveniences resulting from the withholding of payments or resolution of disputes in accordance with this section.
Users engaging in fraudulent activity may be permanently banned from the platform and may be subject to legal action.

7. Fees

We charge fees for various services:
  • Marketplace transactions: $1 per transaction
  • Vaulting: Monthly storage fees as disclosed
  • Auctions: Listing and transaction fees as disclosed
All fees are clearly disclosed before you complete a transaction.

8. Intellectual Property

All content on our platform, including trademarks, logos, and software, is owned by CatchBack or its licensors. You may not use our intellectual property without permission.

9. Limitation of Liability

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, CatchBack shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold CatchBack harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

11. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

12. Dispute Resolution

These terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through individual arbitration, not class action lawsuits.

13. SMS/Text Messaging Terms

By providing your mobile phone number to CatchBack Cards, you consent to receive recurring text messages (SMS) from us, including order confirmations, shipment and delivery updates, account and security alerts, and — where you have separately opted in — marketing and promotional messages.
  • Message frequency varies based on your account activity and transactions.
  • Message and data rates may apply. Your mobile carrier’s standard messaging and data rates apply to all messages.
  • To opt out, reply STOP to any message at any time. You will receive a confirmation and no further texts unless you opt back in.
  • For help, reply HELP to any message or contact us at catchbackcards@gmail.com.
  • Carriers are not liable for delayed or undelivered messages.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. For details on how we handle your information, see our Privacy Policy.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of our services after changes constitutes acceptance.
